首都・東京を襲った激しい揺れ-。11日の東北・太平洋沿岸地震で、都内では6年ぶりとなる震度5強を記録した。この地震で3人が死亡したほか、葛飾区内で送電線の鉄塔が倒壊するなど被害が相次いだ。都は地震発生直後に災害即応対策本部を設置した。交通網もストップし、帰宅の足を奪われた通勤客がターミナル駅などに集中。各自治体は帰宅困難者のために公共施設や学校を開放するなど、対策に追われた。



≪鉄塔倒壊、天井崩落≫

葛飾区によると、亀有の東京電力敷地内にある鉄塔の上部が倒壊した。新小岩の2階建て店舗の壁が落下して通行人に当たり、5人が頭にけがをするなどした。東金町では地下水道管が破裂。近くで道路が隆起しているのも見つかった。液状化現象の可能性もあるという。新宿区では区役所の住民基本台帳システムが地震発生直後にストップ。約1時間で復旧し、大きな混乱はなかった。

多摩市では、マンホールのふたが飛んだとの情報があるほか、和田の市立和田中学校で2階天井の一部が落下した。小平市でも、ブロック塀の倒壊や屋根瓦の落下などがあった。日野市では特別養護老人ホームのガス供給が止まり、暖房に影響が出たほか、小学校などが断水した。

都教育委員会によると、午後7時現在、都内の公立学校では、小学校で計8人がけが。小学校91校、中学校69校、全日制高校97校など計316校でガラスが割れるなどの軽微な被害があった。

≪デパート混乱≫

発生時、都心のデパートも混乱した。大丸東京店(千代田区)は発生時、エレベーターが全て停止した。最寄階で止まって脱出できたので、閉じ込めなどのトラブルはなかったという。午後3時15分に営業停止を決定。店員はその後、後片付けなどに追われた。

新宿高島屋(渋谷区)では、午後4時過ぎの時点で、3千~4千人が店内にいたが、けが人はいなかった。全てのエレベーター、エスカレーターが停止し、子供連れの客などは椅子で休んだり、床に座り込む姿も見られたという。

通常午後8時までの営業時間を7時に繰り上げて終了したが大きな混乱はなく、買い物客は退出した。

同店では「店員は、近くに住んでいる人を除いて、館内に残った者も多いと思う」と話していた。



■座り込む女性/公衆電話に行列

立川市のJR立川駅にある駅ビル4階の婦人服売り場は地震発生と同時に大きく揺れ、買い物客から悲鳴が上がった。客らは立っていられず、座りこんだり、手すりにつかまったりした。マネキンは倒れ、エスカレーターのそばでは座り込む女性の姿もあった。女性店員らが「姿勢を低くしてください」「落ち着いてください」と叫び、揺れがおさまるのを待った。

駅の外では、営業を中止した駅ビルの客や、運休となった電車に乗り損ねた乗客らであふれた。多くは携帯電話を片手に、ビルの外壁に設置された大型モニターに流れるニュースを食い入るように見つめていた。

北口駅前のビルではガラスが割れ、一部が下に落下。粘着テープで応急処置したり、ビル管理会社の従業員がハンマーを使ってガラスをたたき落としていた。

駅前の交番では、自宅まで歩いて帰る道を尋ねる人の姿も。電話ボックスの前には行列ができていた。

国分寺市の主婦(66)は「携帯電話で家族と連絡を取ろうとしたがつながらなかった。公衆電話なら大丈夫だと聞いたのでもう40分ほど待っている」と不安そう。「電車が動いていないので、立川にある親戚の家に泊まります」と話していた。



地震の影響で、都内の交通が止まり、東京駅でも帰宅の足を奪われた通勤通学客らが困惑した表情で運転再開をまちわびていた。

千葉県習志野市、教員、小泉雅子さん(56)「教育関係の研修で東京駅の近くのビルの中にいた。隣のビルもかなり揺れていた。都内で働いている夫と合流したら、どうするか考える。日本は治安がいい、何とかなるだろう」

千葉県船橋市、無職、熊谷勝行さん(66)「友人との待ち合わせで、霞が関の東京地裁のロビーにいた。久しぶりに友人と一杯飲む予定だったが仕方ない。有楽町駅にいたが、寒かったので東京駅に来た」

千葉県習志野市、千葉工大3年、坪井一守さん(21)「就職活動を終え、赤坂見附駅のそばで地震に遭った。実家が静岡なので、東海地震かと思った。これだけの地震はこれまで見るだけだったが、実際に受けてみると大変だ」

千葉市の佐藤貴子さんと斉藤明日香さん、千葉県佐倉市の吉田綾乃さん=いずれも(18)「高校の卒業旅行で(父親が単身赴任している)青森県八戸市へ行くところだった。新幹線が発車する前に地震が起きた。どうしよう」

新宿区西新宿、外資系会社員、スティーブン・ウェイさん(34)「カナダから日本に来て9年。こんな地震、経験ない。怖かった。カナダの家族は知っているかどうか。電話もつながらないし。どうやって帰るか、いま考えているところ」

東北や関東地方を襲った「東北地方太平洋沖地震」は、12日も各地で被害の報告が相次ぎ、死者・行方不明者は1000人を超える見通しとなった。警察庁によると、死者は岩手、宮城、福島各県を中心に午前8時現在で計217人が確認され、行方不明者は681人。これ以外に仙台市若林区で水死とみられる200~300人の遺体が見つかったほか、宮城県名取市の海岸で100人程度の遺体が見つかったとの情報があり、被害はさらに拡大する恐れがある。

一方、東京電力によると、福島第1原発(福島県大熊町、双葉町)の正門付近で、通常の約20倍の放射線量が検出された。放射性物質が漏れた可能性があるという。

各県や総務省などによると、宮城県気仙沼市や岩手県の太平洋側では大規模な火災が発生。気仙沼市は津波で市街地の3分の1が水没し、気仙沼湾に浮かぶ大島の4集落が壊滅状態となった。
岩手県陸前高田市は8割が水没、宮城県女川町もほぼ壊滅状態という。宮城県によると、県内の高校や病院など計423カ所に約6万人が避難、救助を待っている。

また防衛省は、福島県南相馬市の約1800世帯が壊滅状態としている。

気象庁は12日午前3時20分、国内の全66予報区で大津波警報、津波警報、津波注意報のいずれかを発令した。全予報区での発令は初めて。

JR東日本は、宮城・岩手両県で地震後に乗務員と連絡が取れない列車が計4本あると発表した。
東電によると、福島第1原発2号機は冷却機能が停止。1号機も原子炉格納容器内の圧力が上昇したため、破壊を防ぐため弁を開く。微量の放射性物質が放出される恐れがあり、政府は半径10キロ以内の住民に避難を指示した。

【明報專訊】玄彬    前天才入伍服兵役,昨天卻突傳女友宋慧喬    「變節」,其實兩人今年初已分手,結束年多感情,他們的經理人公司昨天發聯合聲名宣布消息,鑑於兩人有新作推出,不想焦點集中在感情問題上,加上玄彬在入伍期間還被問及私人事會非常尷尬,但亦不想一直欺騙觀眾,所以玄彬入伍後即公開分手消息,並強調兩人依然是好友。

玄彬及宋慧喬的聲明表示,自09年中相戀後,雙方各有各忙並多次分隔異地,玄彬為拍攝電影《晚秋》要遠赴西雅圖數月,喬妹因拍攝獨立電影Fetish及王家衞的《一代宗師》,先後到美國    及香港居住,兩人一直聚少離多。加上外界太過關注他們的戀情,不時傳出分手消息,因而備受壓力,就感情問題溝通商談的時間都沒有,所以年初時決定分手。聲明中更特別就一直隱瞞分手向影迷致歉。

玄彬入伍當天推出的歌曲《無法擁有你》,現已雄霸不少音樂排行榜冠軍,他更被指是憑歌寄意,剖白與喬妹分手的心情。現正拍攝新戲《今天》的宋慧喬,導演指她心情平靜,積極工作,據她的身邊人透露,「喬妹為了玄彬能順利入伍,才決定不公布消息,但她亦很討厭一直欺騙影迷。」


玄彬與宋慧喬於08年因合演韓劇《他們的世界》而認識,拍攝初期玄彬曾說:「開鏡前我以為她很難親近,事實證明我錯了。」喬妹亦盛讚對方:「首次見面的印象就是『哇,很帥』,之後很驚訝年輕的他原來很淡定,思想成熟。」互相留下良好印象,劇集拍畢後,玄彬到釜山拍攝劇集《朋友,他們的傳說》半年,但感情不斷升溫,之後更被報章偷拍到兩人約會,終於在09年7月宣布相戀兩個月。

【明報專訊】龍頭代理行美聯一周內兩度向樓市發出警告,該集團高級執行董事黃錦康表示,現時供樓負擔比率維持近四成的健康水平,但若計及樓齡因素,負擔比率已升至近六成;若樓價再進一步攀升,加上息口掉頭向上,屆時供樓負擔有可能逼近97年逾九成水平,呼籲市民別要低估負擔比率上升,並需避免出現「溫水煮蛙」的效應。

繼上周美聯公開指出,樓市已處於「非理性亢奮」狀態後,美聯物業    首席分析師劉嘉輝昨天在記者會上表示,據集團樓價走勢圖顯示,本港樓價自2008年金融海嘯後重拾升軌以來,迄今已累升約66%,現時平均呎價約5557元,距97年高峰期的6208元僅相差約一成。

「勿低估負擔比率」

他亦指出,本港按揭息率持續低企,令供樓負擔比率相應維持近四成的低位,與97年逾九成的負擔比率相比,明顯為低。若將樓齡因素考慮在內,97年錄得6208元呎價所選取的指標屋苑平均樓齡為10.8年,而現時的平均呎價5557元反映的平均樓齡已達19.8年。

若現時同樣以10.8年的平均樓齡作計算,現時樓價實際已高達8343元,較97年高峰時高逾三成。以平均呎價為8343元計算,供樓負擔比率已經高近六成,較之前近四成的負擔比率高近20個百分點,遠高於健康的供樓負擔比率水平。

【明報專訊】蘋果宣布平板電腦 iPad 2 下周五(11日)在美國    開售,英國    、日本    等26個國家亦會在本月25日有售,香港與內地則暫時未有行貨發售時間表,勢再掀起炒機潮。功能提升而且更輕更薄的iPad 2,定價與上一代相同,有水貨舖表示會搶先在美入貨,最快下周六到港,預料會炒至7000至1萬元,市民即使取得政府派錢的6000元,都未必買得起。

薄三分一 備前後高清    鏡頭

蘋果電腦    於本港時間昨日凌晨在美國三藩市    舉行iPad 2發布會,由久未露面的總裁喬布斯(Steve Jobs)介紹新產品。iPad 2分為Wi-Fi版及Wi-Fi加3G版,備有黑白兩色,新機較第一代薄三分之一,增設前後高清鏡頭,亦可以HDMI連接高清電視播放,運算速度亦較快。

蘋果股價升近2%

價錢方面,iPad 2與舊版維持同一售價,最便宜的16GB Wi-Fi版售499美元    (3890港元),最頂級的64GB容量3G版本售價為829美元(6466港元),蘋果同時又推出售價39和69美元(約304至538港元)的磁力保護套。對於今次定價低,喬布斯笑說:「人們質疑那是否『無法相信』的價錢,(你們)問問我們的競爭對手吧。」

坊間對iPad 2的反應普遍正面,《華爾街日報    》的網上民調顯示,受訪約5000名網民中,六成八人表示會購買iPad 2,蘋果股價於iPad 2公布後上升不足1%,昨晚開市前段再升逾1%,相反,由於iPad 2定價較對手摩托羅拉    的Xoom便宜,摩托羅拉股價昨日下跌約4%。

先達接受預訂 料白色版搶手

由於香港與內地都不在首兩輪開售地區名單,行貨正式抵港前,必再掀起炒風。旺角    先達水貨店G-World Mobile昨日已開始接受客人預訂iPad 2,負責人劉志剛表示,已安排人手在iPad 2首賣日於美國入貨及網上訂貨,首批計劃購入約60部,先試市場反應。他預料,iPad 2炒價將與第一代一樣,由7000至1萬元不等,較行貨貴六至七成,首推的白色iPad 2相信較搶手,可能再貴數百元,iPad 2配件會以雙倍價錢出售。

同場的數碼動力負責人林先生亦揚言「有幾多入幾多」,他以iPad第一代為例,首日售價由8000至1.2萬元不等,隨即搶購一空,「客人根本不看價錢及容量,最緊要有機在手」。數碼易負責人林先生則說,iPad 2未有大驚喜,最實用都是新機可連接至高清電視,但在蘋果效應下,相信仍有大批捧場客,他會在美購入100部,估計炒價不會超過1萬元。

iPad行貨原價3888至6488元,官方公布iPad 2在月內上市後,第一代行貨即減到2988至5688元,減幅12至23%。記者昨日到旺角的蘋果特許店、豐澤及百老匯,均見不少人查詢iPad售價,西洋菜南街的豐澤更出現買iPad人龍,店員指16GB Wi-Fi版減價後已售罄。百老匯一分店的Wi-Fi版亦只餘32GB版本,3G版則仍有小量存貨。蘋果特許店貨源較充裕,各版本仍有貨。

水貨舖囤貨百部料蝕9萬

那邊廂,有水貨舖仍有大量第一代iPad未賣清。旺角先達廣場不少水貨舖數周前仍大量購入iPad,結果現在「有貨無市」。G-World Mobile負責人劉志剛表示,店內仍存有近百部iPad,昨日起亦要跟隨行貨減價促銷,「希望蝕少口的」,但預料仍損失9萬元。

數碼易負責人林先生則稱,農曆新年前已傳聞蘋果將公布iPad 2,故停止入貨。數碼動力負責人林先生則稱,趁iPad行貨減價仍入貨,「我們會跟行貨售價一樣,並提供更多服務,相信仍有內地客捧場」。

蘋果iPad2可望在香港時間周四凌晨推出市場,預料價格減至399美元    ,較第一代減一成。

報道指出,iPad2面對競爭,將比第一代產品更加輕薄,將有白色框、機身加設前後鏡頭,價格減至399美元。

蘋果上周發出邀請柬,邀請記者出席3月2日(香港時間3日凌晨),在美國    三藩市    舉行會議。蘋果在請柬裡沒有表明目的,只寫著「來看看2011將是什麼樣的一年」,右上角掀起,則露出iPad一角,外界因此解讀蘋果將揭開iPad2神秘面紗。

高盛證券出具報告指出,iPad2正面將有一個攝影鏡頭,提供面對面視頻聊天功能,同時支持GSM和CDMA技術。為確保蘋果利潤,iPad2依舊不會有太多的儲存空間。

據悉,iPad2平均批發價格將下降10%。iPad2處理器也將從A4升級至A5,記憶體升至512MB。因應消費者需求,蘋果可望在機身加裝USB插槽。

外界也會留意總裁喬布斯會否在發布會上出面。以往在類似的場他會出現並主持發布會,但由於他請了病假患病,若他真的不出席,外間肯定對的健康又有揣測。

【凌晨三時最新消息】美國    蘋果公司在香港時間今日凌晨正式宣布推出新一代iPad平板電腦,正在無限期休假的總裁喬布斯親自主持發布會,揭開iPad 2的面紗。它採用雙核心處理器,運算速度比第一代iPad快1倍,但售價不變,3月11日起美國發售,3月25日起擴至另外26個國家和地區。這是喬布斯請病假後首次公開露面,蘋果股價在他現身後即時彈升逾1%。

喬布斯現身發布會,來賓十分驚喜,報以歡呼並站立鼓掌,喬布斯說:「我們開發這產品一段時間,我不想錯過今天」。他一如過往,身穿黑衣牛仔褲,看上去頗精神,現場觀眾形容喬布斯看來沒改變。

快一倍 厚8.8毫米1.3磅

他表示,新一代iPad採用蘋果自家A5處理器,圖像表現較舊款優勝8倍,有hdmi高清    影像輸出;新版有前後鏡頭,厚度僅為8.8毫米,比厚9,3毫米的iPhone還薄,比舊款iPad更足足薄了4.6毫米,重1.3磅(較舊款輕0.2磅),有白色和黑色兩種款式可供選擇。售價方面,16GB WIFI 版本單價 499美元    (3892港元), 32GB WIFI 版本599美元(4672港元),64GB WIFI版本 699美元(5452港元), 16GB 3G版本 629美元(4906港元), 32GB與64GB分別售729(6162港元)與829美元(6466港元)。

喬布斯稱,業內人士把iPad視為迄今最成功的電子消費產品,其結果是蘋果佔據了平板電腦逾九成市場。他還宣布,全球最大出版商蘭登書屋(Random House)正式加盟蘋果電子書店,軟件開發商迄今從App Store賺了20億美元,而第1億部iPhone最近剛剛付運。

現時全球已發售或正在開發的平板電腦逾百種,競爭激烈,《華爾街日報    》報道稱,新一波的iPad熱潮,可能觸發一場平板電腦減價戰。據調查公司PRTM統計,已發售或開發中的平板電腦達102種,使用不同作業系統的競爭者都希望與iPad爭奪最暢銷平板電腦寶座。貝克說,價格戰「在所難免」,若iPad 2定價過高,蘋果可能會在今年假期銷費季節來臨前,遭競爭者低價競爭。

波士頓顧問集團(BCG)去年12月針對16國1.4萬名消費者所做的調查顯示,有53%的消費者偏好多重功能的平板電腦,只有13%的消費者偏好亞馬遜Kindle和索尼Reader這類單一功能的電子書閱讀器。但調查同時發現,消費者眼中的平板電腦理想價位在200美元(約1560港元)以下,顯示目前市面上的平板電腦價格普遍過高。

【明報專訊】市民群情洶湧反對預算案,周日上街在即,財政司    長曾俊華    在宣布預算案僅一個星期,便宣布大幅修訂預算案「派真銀」,3項措施總共派約423億元。其中,政府向全港18歲或以上的永久居民(約600萬人),不分貧富每人派發6000元,涉及開支高達360億元,更是開埠以來首次。不過,是次派錢「派出血」,令原來有盈餘的預算案,變成赤字逾百億元的預算案。建制派議員普遍支持修訂,但泛民議員則炮轟政府過於短視,胡亂派錢,呼籲市民「食住粒糖去遊行」。

本報的民意調查顯示,在宣布大派真銀後,表示會參與遊行的受訪巿民,比之前下跌逾12個百分點。

開埠以來首次派錢

曾俊華昨早9時半與30多名建制派議員會面,公布修訂預算案,由於建制派會後表明一致支持,預算案一定能於4月中獲通過。大部分泛民議員則表示,曾俊華試圖以派錢為遊行降溫,目光短淺,加上政府全面「打倒昨日的我」,誠信破產,因此會繼續反對預算案,發動市民遊行。

派錢退稅還富於民

公布預算案後民望大跌的曾俊華昨表示,考慮到社會對注資強積金    的意見,決定不再向強積金戶口注資240億元,他同時公布3項還富於民方法(見表一):

(1)向全港18歲或以上、持有香港永久居民身分證的市民派發6000元,市民可按本身的需要全數提取現金,措施亦會加入鼓勵儲蓄的元素;

(2)針對一些未能受惠「派6000元」但有特殊需要的市民,政府會額外預留一筆款項,提供足夠資源另作處理;消息指,受惠人士主要是新移民    ;

(3)退稅,退還薪俸稅75%,上限6000元。

2011/12年度將錄144億赤字

綜合政府消息及本報計算,3項措施一共涉及開支423億元,配合預算案其他如電費補貼、免差餉    等「派糖」措施,這份預算案派了足足620億元,破盡回歸後所有預算案的派糖紀錄。政府剛於上周表示,2011/12年度將錄得39億元盈餘,如這收支估計正確,經加碼派錢後將會「見紅」,錄得144億元赤字(見表二)。

曾俊華表示,「人人派6000元」,令公務員、退休人士及家庭主婦都受惠,此安排較預算案注資240億元更全面。此外,政府消息說,退稅不會退支票,只會在明年稅單中扣除。

承認「社會有非常強烈訴求」

曾俊華公布派錢方案後,即被傳媒「翻舊帳」,稱他過去多次強調政府不會推出刺激通脹措施、堅拒退稅和派現金,但曾俊華昨日卻180度轉軚,解釋說「我們現在最重要的事,就是要凝聚共識……通脹問題仍不可掉以輕心,大家聽得很清楚,現社會上有非常強烈訴求,我在平衡不同考慮下,作出這個決定」。他承認有一些預算案中的措施得不到市民認同,如今是「回應市民要求」。

這份預算案是回歸以來評分最低的預算案,加上市民聲言上街遊行,特首曾蔭權    前日疑遭不滿預算案人士襲擊,曾俊華被問到是否需向曾蔭權和市民道歉,曾俊華結巴地回應﹕「我想,有……有……有……有……有……有些奇怪你(提出)這個提議。我剛才已經講過,現時我們最重要做的事情,就是凝聚共識,我們會繼續努力看如何可以推行這方面的事情。我們會繼續保持溝通,回應市民的訴求。」財政司長辦公室解釋,司長是指向特首道歉的建議奇怪,並非指向巿民道歉奇怪。

【明報專訊】財政司    長曾俊華    就預算案紓困措施爭議,7日之內作180度轉變;為求救火,曾俊華徹底打倒昨日之我,破天荒式派錢,違背公共理財原則的要求。對曾俊華個人而言,威信掃地;對政府而言,不但威信受損,也顯示失去管治意志。從政府整體管治出發,曾俊華應該以大局為重,考慮個人去留,讓政府重建有效管治。我們認為,今次預算案風暴是一場悲劇,特區政府    掛在口邊的所謂行政主導,只是一句空話;中央政府必須認清香港的現行制度缺陷,實事求是,解決特區政府有權無票的死結。

「3個敗壞」後遺症嚴重

今次預算案的周折,性質十分嚴重,從最廣義而言,顯示政府行政失效,《基本法    》規定的「行政主導」,經此一役可謂蕩然無存,主因在體制缺陷,而主其事的官員曾俊華也有失誤。就狹義而言,曾俊華迄今的表現,對政府施政構成「3個敗壞」。

首先,敗壞了諮詢制度。曾俊華聲稱預算案的措施是聽取了各方意見的結果,事實上,曾俊華曾經出席論壇、會晤各個政黨和學者,更放下身段,落區到市民家中吃團年飯,親自感受普羅大衆的生活,他為了鼓勵市民發表意見,還把自己的鬍鬚拿出來開玩笑。但是事態發展,證明曾俊華所謂聽取意見,實效成疑,因為他與幕僚閉門造車,炮製出來的注資強積金    措施,公布前受諮詢人士並未與聞,而注資不退稅,中產階層和年輕一代對此反彈最強烈。政府諮詢的其中一個目的,就是要拿揑民情,曾俊華經過諮詢後的預算案,無疑向市民宣示諮詢是假,官意是真。這是徹底地敗壞了諮詢制度。

其次,敗壞了官員、政府的威信。上周三,曾俊華發表預算案之後,面對民意強烈反彈,他出席電視台、電台等解釋預算案的場合,都極力辯護,雖然理據重複,未能說服市民,但是此階段,曾俊華堅持原則,就決策官員而言,仍然得到一定尊重。但是,他180度轉變,打倒昨日之我之後,對一星期前所說紓困措施原則,包括不激化通脹、鼓勵市民儲蓄投資未來、幫助有需要的人等原則,完全拋諸腦後,修訂措施與這些原則南轅北轍,曾俊華對此連嘗試自圓其說也不做,這樣的表現,不但敗壞個人威信,整體政府和其他官員的威信也受到拖累。試想想,曾俊華、政府和其他官員的說話,日後在市民心目中還有多少可信度。這是曾俊華敗壞了整體政府的威信。

第三,敗壞了公共理財原則,使信奉謹慎理財核心價值的人無所適從。曾俊華胡亂派錢,被指存在政治考慮,目的使泛民陣營發起的3月6日大遊行,不成氣候,為了這個政治考量,曾俊華罔顧公共理財原則,加碼約180億元,使全部紓困措施高達超過610億元,連同他2007/08年度開始接任財政司長以來,經他派糖所耗用公帑,已經高達約1800億元,如此寶貴的公共資源耗費了,但是收到多少效益?貧富懸殊改善了嗎?曾俊華今年變本加厲,箇中或有特首曾蔭權    的因素,但是反映曾俊華未能堅持原則辦事,就主觀條件、客觀處境而言,說明他已不能適任財政司長之職。

一星期前,曾俊華為注資辯護,聲稱為市民長遠福祉設想,為市民考慮30年以上的生活安排,其高瞻遠矚,雖或有人認為是假大空,仍然使人有一絲感動,但是,昨日公布的修訂措施,則是只放眼3日後的大遊行,這種完全違背邏輯的做法,從一個極端擺向另一個極端,不合乎理性要求,由這種心理狀態的人執掌香港的財政大權,適當與否,值得斟酌。

預算案惹起反彈,連建制派議員也「不敢」支持,以政府在立法會    無票的現實,預算案需要調整和修訂,事屬必然,但是在退讓之時,曾俊華應該堅守核心理財理念,例如絕不胡亂派錢等。事實上,市民對注資強積金而不退稅,反彈最強烈,若曾俊華在注資退讓,例如6000元退稅注資各半,或是由政府代供強積金6000元等方案,應已情理兼顧;曾俊華現在的選擇,顯得過猶不及、藥石亂投,耗費了更多公帑,效果是只撲了火,卻未意圖解決問題。

例如,市民對注資強積金的反彈,很大程度基於強積金不公義的現實,主要在於基金管理人「食水深」,蠶食市民胼手胝足的血汗錢。如果政府真正為市民謀福祉,就應該善用這股民氣,宣布全面檢討強積金的管理和收費,包括盡早推行強積金半自由行等,讓強積金回歸為市民利益服務的原旨,但是政府不作此想,或許是懶得去做,只以大灑金錢化解危機,連可以得分的舉措也輕輕放過,這種心態和做法,顯示政府威信掃地之餘,連管治意志也失去了。

問責非針對曾俊華

旨在讓政府取信於民

曾蔭權政府還有約16個月任期,以近期政府予人感受到的「Hea」的整體氣氛,加上預算案風暴所暴露諮詢運作、決策程序和理財原則的制度性崩潰,我們認為,曾俊華應該考慮個人去留問題。

首先,他的威信嚴重受創,明年怎樣制訂預算案?

其次,曾俊華是問責官員,預算案出了如此大問題,整體社會被折騰了一個星期,難道就此罷了?曾俊華應該有所抉擇,使問責制    不致再次成為笑話。

第三,曾俊華已經成了曾蔭權政府的負資產,若引退,可以讓政府有較大空間重新展示管治意志,重建有效管治。

我們要求曾俊華就去留抉擇,並非針對個人,而是從預算案風暴之後,這個職位應該如何體現政治倫理,並讓政府如何能夠重新取信於民為考慮。

曾俊華今晨再約見建制派議員,介紹其修訂財政預算案後的措施後宣布,考慮到近日公眾對6000元注資強積金做法的不滿,決定轉換平台,18歲或以上永久性居民,可按意願全數直接提取6000元,此舉令更多市民受惠,包括公務員、家庭主婦、退休人士等。對於仍未受惠此措施的有需要人士,財爺表示會預留一筆款額處理。

財爺又說,為回應中產人士對財政預算案的不滿,決定寬免薪俸稅及個人入息課稅75%,上限6000元。

【明報專訊】樓市大旺,甚至凶宅都迅速沽清。昨天舉行的兩場物業拍賣會,當中青衣曉峰園及屯門    大興花園各有一個凶宅單位售出,成交價低於巿價兩成至三成。

環亞物業昨現場拍賣15項物業,成交2項,其中青衣曉峰園第3座中層G室674方呎凶宅單位,以256萬元成交,高出開價218萬元17.4%,呎價3798元。

美聯物業    青衣翠怡分行經理樊志聰表示,該凶宅單位成交價較巿價低22%。本月中,同座低上述凶宅單位僅一層、同朝向及景觀的F室674方呎單位,以330萬元成交,呎價4896元。

該凶宅單位上手業主,去年第二季以178萬元向銀主購入,是次成交帳面賺78萬元,升值44%。據了解,2008年底一名女住戶在該單位內燒炭死亡。

此外,忠誠拍賣昨推22項物業拍賣中,包括屯門大興花園2期1座高層E室753方呎凶宅單位,以186萬元成交,高出開價168萬元10.7%,呎價2470元。

中原地產    巿務經理陳漢文表示,該凶宅單位成交價低巿價28%,原業主於1996年首季以188萬元買入,呎價2504元。

原業主2005年從這單位跳樓身亡,使單位變成凶宅,業權及後料由親屬持有,持貨15年後帳面仍微蝕1%。

運輸及房屋局    長鄭汝樺    表示,政府建議提高公屋入息限額,平均加幅為15.6%,資產限額亦提升3.3%。

鄭汝樺在記者會上表示,因應最低工資在5月1日推出,政府建議將公屋入息限額提升,平均增加15.6%。如一人家庭,月入由7440元,加至8740元(已扣強積金    )。而2人加庭月入由11660元,加至13410元(已扣強積金),3人家庭由13130元,加至15560元(已扣強積金)。而資產限額亦增加3.3%。

她表示,新入息限額增加後,約有13萬多戶在私樓家庭可入住公屋,增加了約2.5萬戶,約佔私樓非業主住戶的三分之一。

(星島日報    報道)《預算案》宣布加煙稅四成一,不少煙民在加稅前四處撲「平價煙」,有便利店卻涉嫌囤積香煙,加稅後乘機「稅外加價」出售。立法會    議員李卓人    接獲投訴指,連鎖便利店「7-11」通知分店在《財政預算案》公布前,只准賣架上的香煙,售完即止,直至《預算案》公布後才可出售存貨,他批評「7-11」囤積居奇,估計「7-11」因而獲利近六千萬元,並要求政府徹查是否有人「走漏風聲」。


立法會議員李卓人昨召開記者會,稱接獲一名「7-11」特許經營店職員投訴,指「7-11」要求分店在《財政預算案》公布前囤積香煙。他展示投訴人提供的「7-11」發出的內部文件,指「7-11」香港及澳門    營銷及業務董事陳永堅,於二月二十二日《預算案》公布前一天,呼籲所有分店員工,因香煙供應緊絀,有店鋪出現供不應求,故「現店鋪只售賣櫃內煙架的香煙,售完即止」,直至翌日《財政預算案》公布後另行通知。


有分店倉存五千包煙


李卓人指,據他了解有店鋪囤積了五千包香煙,若以每包香煙在《財政預算案》公布後加價十三元計算,該店便獲利六萬五千元,若全線九百六十家「7-11」都有類似情況,「7-11」集團便獲利近六千萬元。


他質疑事件涉及利益輸送,令「7-11」在《財政預算案》公布前囤積居奇,「點解『7-11』會知道加煙稅?是否有消息給了『7-11』?」他要求財政司    司長調查事件,並向立法會提交報告。至截稿前,財政司司長辦公室仍未有回覆。


「7-11」集團隸屬於牛奶公司集團。牛奶公司集團北亞區地區董事兼中國行政總裁麥瑞瓊表示,她身處外地,不知道事件詳情,要求傳媒直接向「7-11」集團公關查詢;「7-11」集團發言人則回覆指,於《財政預算案》公布前,增加煙草稅之消息已廣泛流傳,因顧客估計政府會加煙稅而令各分店香煙出現供不應求,故「7-11」決定於《預算案》公布前,限制每位顧客每次最多限買兩包,以便提供香煙給更多顧客。


此外,《財政預算案》公布加煙稅每包十元,煙商已把部分暢銷香煙加價十一元至每包五十元,但「7-11」及OK兩大連鎖便利店集團更坐地起價,將部分暢銷香煙零售價再調高兩元,至每包五十二元,惹來煙民及立法會議員批評是趁火打劫。

【明報專訊】據內地媒體報道,內地多個城市近期出現黃金搶購潮,民眾排隊爭購黃金首飾和金條。有東北的「金老闆」更直接南下深圳    入貨,就算一次過買10公斤(約值380萬元人民幣)也只能算是「散客」。而在中國黃金產量第一的山東省,當地有黃金市場每天剛將黃金擺進櫃台就被搶購一空。

「你根本沒有選的餘地,只能搶購。」《新文化報》引述長春金飾店老闆李京說,他和助手到深圳水貝市場入貨,「原來每次都是空運幾公斤黃金飾品,現在情况變了,你買不買對於加工廠來說眼睛都不眨一下,即使一次性將成交12公斤的買賣,在他們的眼裏也只能算是小客戶。」

山東金市 未進櫃台即搶光

「我們的採購地主要集中在深圳、北京    和上海    ,前幾年都是加工廠搶著聯繫我們,現在改了,我們得和加工廠搞好關係,否則就沒貨,現在各地金店老闆都在四處囤金。」李京說,此行先要打電話溝通,再和一間加工廠的銷售經理先疏通關係,才買夠12公斤黃金飾品。據資料顯示,深圳是中國最大的黃金加工基地,有2000多間黃金加工廠,進出口總量佔全國的1/3。

而據中央電視台報道,在山東省濰坊市昌樂縣的黃金市場「寶石城」,每天早上8點,黃金還來不及擺進櫃台就搶購一空,購買者不管是金條還是首飾,見貨就買,批發均價已上漲到每克303元人民幣,接近2010年的歷史最高位310元,但每天新加工的供應量遠遠不能滿足需求。

《中國企業家》報道,自2002年中國開放黃金交易開始,金價已上漲了6倍,幾乎所有參與者都賺到錢,從未聽過有黃金交易公司倒閉,只有不斷新開張。據世界黃金協會統計,2010年第三季度中國投資金條的銷售比2009年增長了64%,破紀錄地達到45.1噸。

不過內地黃金市場存在大量灰色地帶,公安部統計,全國共有7000間地下炒金公司,號稱代理「倫敦    金」、「香港金」,其實是吸引民眾用50至100倍的槓桿來購買黃金投資產品,蝕了錢就卷款潛逃。但現時並無針對黃金市場的專門法規,所以良莠不齊的投資公司仍然大量存在。

新app口號直接了當:「你喜歡某人。他們在戀愛中。成為首個知道他們失戀的人。」開發者勒文赫茨(Dan Loewenherz)透露,自己是在聽未婚妻與她母親聊天時獲啓發,當時準岳母想撮合另一未婚女兒與一名已有對象的男士,準岳母開玩笑道,若是能知道他什麼時候失戀就好了。

「分手通知」每24小時檢查戀愛狀態的改變。勒文赫茨有一些安全溫馨提示,例如若某人狀態顯示為已婚,可能就不建議將其列為關注對象了。該程式使用了Google的App Engine提供電郵服務,監測戀愛狀態則採用Django與facebook Graph API。

YCombinator網站上有人發帖稱「這是所看過最無意義、最微不足道、最可笑和可怕的程式」。但也有人稱這是個「偉大的想法」並稱和愛侶就是透過「分手通知」提示開始關係。

勒文赫茨表示,這個app很大程度只為好玩,但用家大可享受其中樂趣。過往有心理學研究顯示,過分沉迷facebook可能會發展為「facebook相關焦慮症    」。

不過近期已少有在微博露面的成龍,昨午卻突然「現身」,並對王力宏    在微博上載的一幅畫發表回應﹕「很想房先生喜歡的照片呀!」該幅油畫是一幅嬉皮笑臉的油畫,不知是否當中含意是笑罵由人?該油畫作品為當代藝術家岳敏君作品,他畫作形象鮮明突出,深受歡迎,成龍看畫就想起自己兒子房祖名    ,一向望子成龍的他,是否也希望他的小房子(房祖名)也懂得欣賞中國文化藝術?雖然不少fans在微博中留言關心及支持成龍,但仍希望他回應一下激吻風波,但成龍一於「隱身」,未有回覆。

至於徐靜蕾前日在微博形容今次事件是個冷笑話之後,昨日就索性在微博大講做45分鐘瑜伽身心舒暢,同樣不再回應事件;不過其經理人公司發言人則代徐靜蕾澄清,指當晚徐靜蕾只是出席朋友聚會,有工作人員陪同。發言人段小姐說,徐靜蕾和成龍未有任何親密關係,僅是離開時,成龍禮貌式送上車並吻額頭,作為道別之吻,並未有肉緊激吻,兩人近期亦沒有什麼合作計劃,希望事件早點結束。

昨日網上更有一段當時激吻風波發生的過程片段,亦見到成龍送徐靜蕾上車後,他伸頭入車厢捧住對方臉頰吻下去,但因為鏡頭有點矇,看不清楚是吻額還是嘴,不過一吻後,成龍就已站直身子,兩人揮手拜拜,想不到一個GoodBye Kiss發生在惹火的成龍身上,就一發不可收拾了。

Macau Home Prices May Climb as Much as 20% as Casino Growth Fuels Demand

Macau home prices, which have recovered to pre-global credit crisis levels, may rise as much as 20 percent this year as the city’s economy benefits from an expanding casino industry.

Residential values in the world’s biggest gambling hub will gain 20 percent in 2011, according to Midland Holdings Ltd., Hong Kong’s largest publicly traded real estate agency. Jones Lang LaSalle Inc., the world’s second-biggest commercial property broker, predicts a 10 percent gain, while London-based Savills Plc forecasts a 15 percent jump.

Low interest rates, a lack of new supply and rising personal incomes driven by a 58 percent surge in casino revenue helped real estate prices in the former Portuguese colony in southern China climb 15 percent in 2010 even as the government introduced measures to stamp out speculation.

“The property market is now being supported by locals whose incomes have risen off the casino boom, and also the huge demand for rental from foreign workers coming in for the new casinos and other infrastructure projects,” said Gregory Ku, managing director for Macau at Jones Lang.

Casino revenue in Macau may climb 30 percent to $30 billion this year as visitors from mainland China increase, CLSA Ltd. said in a report last month. China contributed more than half the number of Macau’s 25 million tourist arrivals last year.

Macau’s casino revenue grew to more than four times that of the Las Vegas Strip after the government allowed the entry of overseas operators in 2002, including Las Vegas Sands Corp., the world’s biggest casino company by market value, and Wynn Resort Ltd., ending billionaire Stanley Ho’s four-decade monopoly.

Local Investors

Prices for some luxury projects, such as the One Central Macau Residences co-developed by Ho’s Shun Tak Holdings Ltd. and Hongkong Land Holdings Ltd., have risen to about 6,000 patacas ($748) to 7,000 patacas a square foot at the end of last year from about 4,000 patacas in early 2009, according to Jones Lang.

About 10 percent of those who bought the properties last year were foreign investors, compared with about 35 percent between 2007 and 2008, said Ku.

“The credit crisis has pretty much driven out all the foreign funds looking to make a quick profit,” he said.

Galaxy Entertainment Group Ltd., the casino operator part- owned by Permira Advisers LLP, plans to hire as many as 8,000 workers this year after the opening of its 600-table casino in Macau’s Cotai district, Chief Financial Officer Robert Drake said Feb. 15. Macau, the only region in China where casinos are legal, has a population of 550,000.

Huge Demand

The city’s government is building a light-rail system aimed to be finished in 2014 and is working with neighboring Hong Kong and Zhuhai to build a bridge connecting the three cities.

“People are earning more and that’s creating a huge demand to upgrade to better properties,” said Franco Liu, managing director for Savills’s Macau unit. “With limited new land supply in the next few years, there’s so much pressure on prices to keep going up.”

Prices of some luxury apartments have risen as much as 80 percent from the trough during the credit crisis, prompting the government last year to impose higher property transaction taxes and raise mortgage down payments for transactions larger than 3.3 million patacas.

That may lead luxury prices to lag “slightly behind” those in the mass market this year, said Savills’s Liu.

“The measures may push some buyers to shift to lower value properties because they can get a higher mortgage and fall into a lower tax brackets,” he said.

Luxury Prices

With no standard definition for Macau luxury prices, property agencies normally distinguish them from those in the broader market based on location and prices, said Stanley Poon, managing director for Macau at Centaline Property Agency Ltd., Hong Kong’s biggest closely held realtor. Centaline forecasts Macau home prices to rise 15 percent in 2011.

Macau’s luxury home prices fell as much as 40 percent in early 2009 from a previous height in 2007, according to Centaline, after several foreign funds sold investments and developers halted projects as liquidity dried up during the credit crisis.

The number of property transactions fell to 17,000 in 2009, a seven-year low, before rebounding to 30,000 last year, according to data from the Macau government.

Macau’s economy may rise 26 percent in 2010 from a year earlier, according to a forecast by Secretary of Economy and Finance Francis Tam. The jobless rate of 2.7 percent in the fourth quarter was the lowest since 1999, according to government statistics.

Limited Supply

About 80 percent of Macanese own their homes, whose values are still at “a substantial discount” to properties in Hong Kong, about an hour by ferry, said Tom Ashworth, fund manager for Macau Property Opportunities Fund Ltd., which has about $333 million in assets and is developing residential projects including the Fountainside in Macau. Hong Kong home prices have surged about 60 percent in the past two years.

“That gap’s got to close,” Ashworth said. “It’s not going to go to parity, but we believe the current 70 percent discount to Hong Kong could definitely narrow to maybe 50 percent.” Ashworth compared prices at One Central Macau and Hong Kong’s Bel-Air, a luxury apartment project in Hong Kong’s Island South district where units are selling at about HK$20,000 ($2,567) a square foot.

Approval for new real estate and infrastructure projects has slowed since the jailing of a former senior government official in 2008 that sparked a series of anti-graft measures by the government, said Ronald Cheung, managing director for Macau at Midland.

About 2,500 new apartments in projects including the One Grantai and The Riviera Macau are expected to be completed in 2011, down from 3,400 in 2010, he said. Annual completion will probably fall below 1,000 in each of 2012 and 2013 before rebounding in 2014.

“This two-year gap will continue to push up both rents and prices for new units,” Cheung said. “Buyers are also mindful of the threat of inflation that’s driven by the low interest rates,” which are near 20-year low, he said.

曾俊華在財政預算案中表示,為增加強積金和職業退休計劃成員的退休儲蓄,建議為所有在今年2月23日已成為強積金計劃或職業退休計劃下,受香港《僱傭條例    》涵蓋的成員的人士,向他們的強積金戶口一次過注入6,000元。

What we still don't know about Lasik
As the surgery continues to plague patients like me, the man who approved it for the FDA pushes for a recall

How are your eyes?


That's all anyone ever wants to know these days: How my eyes are doing after my collision with Lasik almost three years ago. Are they still dry? Do they still hurt when exposed to sunlight? Is my vision still blurred? And what about glasses -- am I still wearing them?


The answer: Yes, yes, yes and yes. Emphatically, resoundingly, blindingly yes. My eyes sting. They burn. I look at neon signs and the colors bleed into a fluorescent Rorschach test. I have difficulty deciphering black lettering on white boards; I have personally helped elevate the stock of Allergan, which manufactures Refresh Plus, the drops that allegedly help dry eye.


Lasik Hong Kong 

Clearly, this is all very annoying, but at this point, I'm used to it. It's just one of the things I live with, like PMS and hangnails. And in the grand scheme of things, it's not so bad. According to Market Scope, LLC, an ophthalmic industry research firm, nearly 15 million procedures have been performed in the U.S. over the last decade, with a 95.4 percent patient satisfaction rate. Lasik is also a $1.6 billion industry -- which, as Michael Lewis points out in "The Big Short," was initially created to replace the revenue stream lost to declining cataract surgery reimbursement rates.


Ninety-five percent satisfaction is not awful (although of course it depends on what your definition of "is" is). It's the other 5 percent that worries me. I've interviewed people who've had corneal transplants because of botched Lasik, who've lost their jobs because they can't see -- like Los Angeles Dodger Jay Gibbons, who reportedly stopped playing winter ball in Venezuela because of blurred vision he acquired after Lasik surgery earlier in the season, the L.A. Times reported.


So all in all, I'm pretty lucky. But I think it's fair to say that I'm angry. Not just about my situation, but because this is an industry where it's almost impossible to find a reputable refractive surgeon to speak out on behalf of patients. If you've got a problem, it's your fault. I went to a dry eye specialist in New York City, a guy who wrote a book on the subject. He acknowledged that Lasik causes dry eye and that it's a major surgical side effect.


"Would you ever say that on the record?" I asked.


He shook his head somewhat sheepishly. "We do Lasik here," he explained. Aha! Talk about a smart businessman. He's got the problem and the solution under one roof.


Attorneys also have trouble finding doctors to testify for patients. On June 2, 2009, Todd Krouner, a lawyer in Chappaqua, N.Y., who has won millions of dollars for injured Lasik patients, cross-examined a Dr. Wing Chu in a case involving a patient with post-Lasik ectasia, a bulging of the cornea. Dr. Chu is medical director of the Eye-Bank for Sight Restoration, and an associate clinical professor of ophthalmology at Columbia University, among other appointments. He was hired by the defense to conduct an independent medical examination of the patient. Here's how that conversation went:


Krouner: "Is your version of the Hippocratic oath "first do no harm" translated "first do no harm to any ophthalmologist," is that your interpretation of the Hippocratic oath?"


Chu: "That's a part of it."


Oh. Good to know.


The hero here is a man named Morris Waxler, whom I wrote about last year for Salon. Waxler is a Ph.D. and a former branch chief of the FDA's Center for Devices and Radiological Health from 1995 to 1999. He was, in effect, the man responsible for approving Lasik vision enhancement lasers in 1997. Since that time, he has become rabidly anti-Lasik, publicly admitting that the FDA "screwed up" when it approved it.


Now he's taken his activism a step further. Last month, he filed a petition calling for the FDA to withdraw approval "for all Lasik devices and issue a Public Health Advisory with a voluntary recall of Lasik devices in an effort to stop the epidemic of permanent eye injury caused by lasers and microkeratomes used for Lasik eye surgery."


In his petition, Waxler maintains that the initial approval was based on data that was "dominated by Lasik surgeons working hand-in-glove with Lasik manufacturers. Data recently brought to light exposes this partnership for what it was: a classic example of the fox guarding the henhouse, wherein the primary arbiters of safety and effectiveness of Lasik devices were the device manufacturers and its collaborators." Consequently, he says, the FDA was deprived of knowledge of the full extent of Lasik injuries prior to and during FDA reviews of documents submitted in support of the safety and effectiveness of Lasik devices.


He adds that -- contrary to the FDA's own device-approval standard, which limits adverse events to 1 percent -- published scientific data shows that Lasik devices induce an average adverse event rate of about 22 percent "that persists beyond six months to five or more years."


Lastly, he says, the published data shows that Lasik devices transform healthy corneas into sick corneas that never completely heal; are permanently weakened, vulnerable to trauma and inflammation; cause neuropathic dry eyes; have pathology that progresses annually; are vulnerable to blinding corneal bulging (keratectasia); compromise night vision; have unstable vision corrections that regress; and require eye care that otherwise wouldn't be needed.


This is potent stuff. And it doesn't seem to be the rantings of a bored retiree. "The idea that I had such a hand in getting a product on the market that was messing people's eyes up is disgusting," he says. "My wife said, 'Why are you getting back into that mess? Leave it to other people.' But I couldn't leave it alone. The more I discovered about it, the worse it got. Rereading the applications to the FDA that I once read and reviewed and reviewing the published literature since then -- it's not a pretty picture."


It's not a pretty picture, but it seems to be pervasive among the FDA. According to a recent report in the Archives of Internal Medicine, of the 113 devices that the FDA recalled between 2005 and 2009 for posing serious health risks or even death, more than 70 percent had been approved because they were considered similar to other products on the market. "Our findings reveal critical flaws in the current FDA device review system and its implementation that will require either congressional action or major changes in regulatory policy," the authors wrote.


While Waxler stops a centimeter short of using the C word (that would be, "conspiracy"), he does wonder why doctors failed to report adverse, or negative, reactions after five or six months. "They didn't report the data," he says. "They said patients wouldn't come back because as far as they could tell patients were doing very well. It's like asking Iran how many nuclear sites they have and them saying, 'We don't have any.' And saying, 'OK, that's fine. We trust you.'"


The refractive surgery community, not surprisingly, is less than pleased with Waxler. The American Society of Cataract and Refractive Surgery stated that while they laud his commitment to Lasik safety (which they share), they "disagree with his science and conclusions."


"The vast preponderance of clinical evidence shows that Lasik is safe and effective -- a conclusion that the FDA has repeatedly re-affirmed in its multiple reviews of up-to-date information," they wrote. "By failing to follow standard scientific protocol, Dr. Waxler does a disservice to all LASIK patients -- including those few who have had serious problems and who deserve to have them clearly understood."


After talking with Waxler, I called, and e-mailed, and called, and e-mailed again, the FDA to no response. Finally, Karen Riley, an FDA spokesperson, shot me an e-mail: "FDA continues to monitor the safety and effectiveness of all devices, including the lasers approved for Lasik," she wrote. "In October of last year we provided a brief update on our role in a three-part study of Lasik that is still in the beginning phases. It is a project that we hope will yield additional insights about this procedure."


It was a nice pat response, but had nothing to do with Waxler's petition. That response came from David S. Buckles, Ph.D., the ombudsman for the CDRH, and was forwarded to me by a Lasik activist:


"I personally appreciate the effort by Dr. Waxler and colleagues to use this approach to raise these issues with the Commissioner's Office because this is an appropriate venue within which to propose changes to the means by which Lasik devices are regulated," Buckles wrote. "While we in CDRH do not have close contact with proceedings in the Commissioner's Office on this particular matter, my understanding is that the petition is under review at the Commissioner's level to determine whether to accept the petition for consideration.

If the petition is accepted for consideration, and subsequently members of CDRH are tasked to participate in the review, then we will have some visibility into the process. However, until that happens, the status of the petition is not within our cognizance."


In other words: Let's wait and see. And wait some more.


Realistically, of course, it's unlikely that Lasik will be banned. Plenty of people have had tremendously wonderful experiences. Even Todd Krouner, the lawyer, says that he "knows and respects too many honest, intelligent, competent Lasik surgeons, who 'eat their own cooking' and have had Lasik themselves," he says. "Still, I believe that the public deserves an honest study, free from the bias and influence of the Lasik industry.

There are bright doctors and trustworthy public health officials who have no financial interest in Lasik, who are certainly qualified to perform a credible study. Without that, I doubt that the public will be able to assess the true risks, benefits and alternatives to Lasik surgery. If doctors cannot agree among themselves about the true incidence of ectasia, or much more common dry eye syndrome, how is a patient ever supposed to make a truly informed decision?"


How indeed? It's a good question, and one I'd like to explore further. But not right now. My eyes hurt.

Side effects continue to plague patients like me. Now, as the FDA investigates, one expert admits, "We screwed up"

The other day I got a prescription for eyeglasses. This is not newsworthy in itself except for one thing: More than two and a half years ago I had Lasik (laser-assisted in situ keratomileusis), specifically so I could toss away the spectacles I wore for near-sightedness. I knew that eventually I would need reading glasses, but I would, I was assured, be able to see long-distance for a long time.

Problem is, I can't.

Not only is my vision blurred, but as I wrote in a 2008 article for the New York Times, I still see halos, and not the kinds with angels attached. It takes a good 10 minutes for my eyes to adjust to dimly lit rooms.

My eyes are scratchy and as dry as the desert. Yes, before I got the surgery I signed an "informed consent" saying I understood all the possible side effects, but I certainly never knew that they might last indefinitely, and that they would be more than "annoying," as my doctor promised.

But nearly three years later, they are still here. And while I could get an "enhancement" -- that's industry parlance for another surgery to correct errors -- frankly, the only thing I want near my eyes is mascara.

According to the American Society of Cataract and Refractive Surgery, most of the 13.6 million people in the United States who have had Lasik surgery since the first lasers were approved by the FDA in 1998 are pleased with the results. But others have experienced similar, if not worse, problems than I have.

Indeed, the estimated $2.5 billion industry has recently come under fire for its failure to acknowledge potential risks. Last spring, the FDA inspected about 50 Lasik facilities and found that many had no system in place for collecting and transmitting data to the FDA on patients’ reports of post-surgical "adverse events."

And in August, Consumer Reports Health released the results of a survey, which found that 55 percent of Americans who've had laser vision correction surgeries are still wearing glasses or contacts some of the time.

Fifty-three percent experienced at least one side effect within the first four weeks of the surgery; 22 percent of patients experienced them six months after surgery, especially dry eyes, halos, glare and starbursts around lights.

Still, the American Society of Cataract and Refractive Surgery emphasizes that Lasik surgery, which can cost up to $5,000, has a 95.4 percent patient satisfaction rate, based on an analysis of research worldwide from 1996 to 2008, said John Ciccone, a spokesman for the organization. The researchers evaluated 19 studies involving 2,022 patients that specifically addressed patient satisfaction.

"Based on everything we know from the literature, and everything I know from any other elective procedure, Lasik eye surgery is the most successful elective procedure performed," said Dr. Kerry Solomon, a cataract and refractive surgeon in Charleston, S.C., and a co-researcher on the study.

The experience of patients like Jeremy Fox, 26, a college student in Rockford, Ill., who got Lasik about four years ago, seem to support this assessment. Getting the procedure, he said, was one of the best decisions he has ever made. While he does experience some starbursts, he said "it’s not bothersome at all."

But the FDA and others are taking note of what they call "quality of life" issues. In October, the FDA, the Defense Department and the National Eye Institute announced in October a three-year effort to assess adverse effects of Lasik.

The effort will involve gauging how many active-duty military patients at the Navy Refractive Surgery Center in San Diego suffered post-surgical eye problems, and a series of national, multi-center clinical trials that will study the impact on quality of life following Lasik surgery in the general population. In addition, the FDA has reopened a public docket to receive comments through Nov. 15.

"We noted that there was little consistent evaluation of the issues," said Mary Long, an FDA spokeswoman, about the reasons for why the study was initiated.

Erik J. Rupard, a doctor and clinical researcher with the U.S. Army, is among those who think such scrutiny is necessary. "Lasik is the Tiger Woods of medical procedures: deeply and demonstrably flawed, but so many people love it that those few of us who speak ill of it are dismissed as cranks and/or loonies," he wrote in an e-mail message. "I saw lots of dry-eye complications in soldiers in Iraq who had undergone the procedure ostensibly because contacts are too unsafe in that dusty environment, and yet the Department of Defense has done no controlled studies to look at the cost -- human and otherwise -- of these post-refractive issues. I am a clinical researcher, and I know that Lasik, a cosmetic procedure, has never been subjected to the pre- or post-marketing scrutiny that we put even lifesaving drugs through."

Surf the Web and you can find dozens of stories from people who have had post-Lasik difficulties: dry-eye, halos, glare. Some complications have resulted in corneal transplants. Over the last few years patient activists have bombarded the FDA with anti-Lasik e-mails, complaints and petitions.

Among them is John Hoge, 39, a businessman in Port Jefferson, N.Y., who suffered from night glare and halos and regrets not choosing the "zero risk option" of corrective lenses. A few years ago he got some experimental contact lenses that have largely taken care of the glare issue. They are expensive, he added, and are not covered by insurance.

While the FDA's recent efforts have given some patient activists a modicum of peace, many do not feel it is enough. "By not inspecting every Lasik facility in this nation, how is the FDA to know if Lasik doctors are compliant?" said Dean Andrew Kantis, 40, a jet salesman in Fort Lauderdale, Fla., who has experienced double vision, starbursts, halos and dry eyes since getting Lasik in 1999, and operates the Web site LifeafterLasik.com.

Some experts believe the FDA should have taken more care when the first lasers were approved in 1998. "We screwed up," said Morris Waxler, a former branch chief of the FDA’s Center for Devices and Radiological Health Office of Science and Technology from 1995 to 1999. "You know how some drugs have a black box warning --  it’s dangerous because of this, this and this -- we could have done something comparable to that. We should have looked at the worst-case impact on patients, rather than just the very good outcomes we saw in the clinical trials."

Larry Pilot, a former associate director for compliance in the FDA’s bureau of medical devices, and currently a lawyer practicing food and drug law in Arlington, Va., agreed. "It appears that information to provide adequate informed consent was not sufficient for all prospective patients about occasions where a bad outcome could result," he said. “The present dissatisfaction rate of 5 percent is very high. Personally and professionally, I am very disappointed in the FDA."

Spokeswoman Long refutes the notion that the FDA was errant. "The FDA has reviewed safety and effectiveness information included in the manufacturer’s applications for approval," she wrote in an e-mail message. "We found them to be safe and effective when used as indicated and will continue to monitor their safety and effectiveness, in addition to taking necessary and appropriate steps to protect the public health."

Timothy A. Ulatowski, director of the FDA’s Office of Compliance at the Center for Devices and Radiological Health, sent out letters to Lasik ambulatory facilities last May reminding them that all risks must be mentioned in every Lasik advertisement online, in print, radio or TV.

"As part of our ongoing review of Lasik and its impact on public health, we continue to look at various aspects of Lasik advertising and how we can better improve public health," said Long.

Still, an informal online search showed dozens of doctors' Web sites that do not mention risks or side effects.

As for the new study, Larry Pilot is not impressed. "The FDA is beginning to do what should have been done 10 years ago," he said. "The bottom line here is that upwards of scores of thousands of human eyes have been irreversibly damaged unnecessarily."

Dr. Solomon disagreed, maintaining that the FDA clinical trials on Lasik lasers were "rigorous" and "well-performed." "I think the FDA did an outstanding job at evaluating the technology," he said. "And the technology and procedure since approval have only gotten better."

As for me, if I had to do it all over again I wouldn't. But hindsight, alas, is 20-20.

【明報專訊】政府去年11月中推出額外印花稅,遏抑樓市炒風後,樓價曾曇花一現回落,但私宅供求失衡再度令樓價很快回升,昨公布的城市大學    與中原地產    合作的中原城市領先指數顯示,截至本月13日,最新報93.41點,對上一周為91.45點,換言之,整體二手樓價一周上升2.14%。樓價升勢正在加速,指數更創1997年11月2日以來新高。中原預測,今年上半年樓價將跨越97年巔峰。

現較97高峰相差一成

下周港府將公布財政預算,各政黨呼籲政府要再出招遏抑樓市,特別是復建居屋(見配稿)。另外,有8家發展昨入標被視為利潤較低、首個規限單位面積(限呎)項目前元朗村用地,反映發展商搶地心切,看好後市。

本港樓價的歷史高峰為1997年10月19日,當時指數報102.93點,現時最新指數仍較當時相差約一成。上述最新指數,主要反映三周前的交易情况(即1月24日至30日的農曆年假前一周)。地產界人士指出,近二三周樓價升勢有可能更急,中原聯席董事黃良昇稱,只要指數每周上升0.5點,20周後指數便可跨越97高峰。

分區方面,港島、九龍、新界東及新界西區樓價全面上升。港島區指數103.19點,按周上升1.61%,樓價只要再升1.3%,便可以壓倒97年10月26日的104.44點歷史高位。九龍區指數90.29點,按周上升2.34%;新界東區指數報88.11點,按周上升1.98%;新界西區指數報72.69點,按周上升2%。

另方面,昨日截標的前元朗村用地吸引8家發展商入標,反應較市場預期佳,入標包括多家主要發展商如新地、長實    等,恒地方面則稱因為地質問題(項目章程指出有溶洞風險),沒有入標。近年主力興建豪宅的大昌集團    亦罕有入標,大昌執行董事李永修表示﹕「項目位置理想,雖然限呎,但對項目絕無影響」。

限呎元朗村地皮 8發展商入標

有建築師認為,項目雖限呎,但無法限制日後的發售價,相信中標的發展商會在項目設計下工夫,令日後買家可打通單位,突破限呎。他認為,推出限呎項目,作用不大,不過是政府安撫市民的手法。

中原測量師黎堅輝說,雖然該地皮限呎,但地盤大,相信發展商可於整體規劃及用料上升級,令項目有利可圖,料項目日後呎價可達5000至6000元。
